City-Proposed Parking Ramp

The Congregational Council will meet on Sun., April 20 at 11:45 a.m. at Trinity Lutheran Church in the Worship Center to propose a motion for an exchange of land between Trinity and the City of Stillwater. A description of the property to be exchanged is available below. Members are invited to attend and vote on the motion. This exchange is proposed to make possible the construction of a city-owned parking ramp between Second and Third Streets, immediately to the east of Trinity. The Council calls this meeting and presents this motion in response to the work and recommendation that has been completed by the Trinity for Tomorrow team.

The Parking Ramp is a Good ThIng!
• Access to 300+ parking stalls
• No charge on Sunday mornings and certain other important dates – e.g., Christmas Eve, etc.
• Renovated parking lot to our east
• No cost to Trinity to build, install and maintain East Lot, Bridge or Ramp
• Elevator access in SE corner of ramp
• Access to both Second and Third Street
• New ownership of parking lot on corner of 4th & Myrtle
• New flexibility for usage of Croix Center/School parking lot
• Future opportunity to enhance the Third St access to Trinity
• Parking for proposed development on corner of Third & Myrtle
• Zoning requirement credit for parking access
• Dedicated # of stalls
• Opportunity to partner with the City of Stillwater, facilitating creation of a valuable new community asset!

The Cost to Trinity
If the Ramp Gets Built
• Land Exchange must happen (Map of the exchange)
• Fee Title Transfer of two “Lots” on Third Street
     Lots 17 & 18 of Block 19
         Represents about 29 Stalls
         Owned parking  – inclusive of ongoing maintenance
         “Effectively” used by neighbors
• Permanent Parking Easement to lot 16
• Offset by value of Fourth & Myrtle parking lot fee title transfer to Trinity

Other costs
• Access, but no dedicated/reserved parking
• Pay parking for other than Sundays and some other events

If the Ramp Does Not Get Built
• Lost Opportunity for additional parking for Trinity


Proposed Resolution:

In connection with the proposed parking ramp and related parking lot (located between Second and Third Street) to be owned, constructed and maintained  by The City of Stillwater, the Congregation of Trinity Lutheran Church, Stillwater, MN (“Trinity”) authorizes The Congregational Council and their designates to negotiate and execute a Development Agreement with The City of Stillwater. 

Such agreement will include: (1) a land exchange of certain properties respectively owned by Trinity and the City of Stillwater and (2) assignment of access and complimentary usage of the Parking Ramp to Trinity, to be specifically detailed in The Development Agreement, including Sunday mornings and such other times and conditions to be negotiated by the Congregational Council.
The land exchange will include: (1) the transfer of fee title to two Trinity properties (“Trinity Fee Property”) and an easement over a third Trinity property (“Trinity Easement Property”) all located on 3rd St (collectively referred to as “Trinity Properties”) to The City of Stillwater and (2) the transfer of fee title to the parking lot, located at the corner of 4th & Myrtle Streets (“City of Stillwater Property”), owned by the City of Stillwater to Trinity.
Adoption of this Resolution authorizes The Congregational Council to negotiate and execute all documents necessary to accomplish the land exchange, including but not limited to the Development Agreement, Easements, and Deed.  The Development Agreement shall be contingent and subject to the approval by The Stillwater City Council.

Property Descriptions:

Trinity Properties
Lot 17 and that part of Lot 18, lying south of a line drawn from the northwest corner of
Lot 18 to a point on the east line of Lot 18 that is 25 feet south of the northeast corner of Lot 18,
And
A temporary easement to construct a municipal parking lot over the north 45 feet of the west 90 feet of Lot 16,
And
A permanent easement for access and parking over the east 30 feet of the north 45 feet of the west 90 feet of Lot 16,

All in Block 19, Original City of Stillwater, according to the plat thereof.

City of Stillwater Property
The West 50 feet of Lot 14, 15, & the West Half (W1/2) of Lot 16, except the easterly Fifteen (E’ly 15) feet thereof, Block Twenty 20, Original Town (now City) of Stillwater.
